This website, scaleforce.co.za, is operated by ScaleForce (Pty) Ltd ("ScaleForce", "we", "us"), a company registered in South Africa (registration number 2021/151114/07).

ScaleForce is the responsible party for the personal information described in this policy, as defined under POPIA. Our business primarily operates at Workshop 17, Cnr Jan Smuts Avenue and William, Nicol Drive, Hyde Park, Johannesburg, 2196.

1. Information we collect

We collect personal information in a few different situations, depending on how you interact with us:

  • When you contact us or submit a form (for example, "Start a conversation" or a discovery request): your name, email address, phone number, company name, and the details you share about your enquiry.
  • When you register your interest in roles through our Talent service: your name, email address, phone number, your field or area of expertise, and the type of work you are interested in (for example, permanent or contract). We do not ask you to upload a CV or other documents through our website.
  • When you browse our website: technical information such as your IP address, browser type, device type, pages visited and time spent, collected through cookies and analytics tools (see section 9).
  • When you subscribe to our insights or communications: your name and email address.

If we later discuss a specific role with you, we may ask you to send us further information directly, such as your CV, employment history, qualifications and references. Where a role requires it, we may also ask for special personal information, such as Employment Equity information, or for your consent to background checks (for example, criminal record or qualification checks). We will tell you what we need and why at that point, and will only process special personal information with your consent or where the law permits it.

Providing your information is voluntary. However, fields marked as required on our forms are needed for us to respond to you or to consider you for opportunities, and we may not be able to help if you don't provide them.

2. How we collect it

We collect information directly from you when you fill in a form, send us an email, call us, or register your interest in roles. We may also obtain your professional details from publicly available sources, such as LinkedIn or job boards, or from someone who refers you to us; where we do, we will let you know as soon as reasonably practicable. We also collect information automatically through cookies and similar technologies when you visit our website (see section 9).

3. Why we process your information

We use personal information to:

  • Respond to enquiries and discovery conversation requests
  • Match candidates with suitable opportunities and make placements through our Talent service
  • Deliver, administer and improve our Advisory, Teams and Talent services
  • Send relevant updates or insights, where you've agreed to receive them
  • Understand how our website is used, so we can improve it
  • Meet our legal, tax and regulatory obligations

We may use technology, including AI-assisted tools, to help us organise and review information. A person at ScaleForce always makes any decision about you; we do not make decisions that affect you based solely on automated processing.

4. Our lawful basis for processing

We only process personal information where we have a lawful basis to do so under POPIA, which includes: your consent, the processing being necessary to take steps towards or perform a contract with you, compliance with a legal obligation, or our legitimate business interests, provided these do not unreasonably override your own privacy rights.

We will ask for your specific consent, which you can withdraw at any time, before we: send you marketing communications such as insights and updates by email or other electronic means; keep your details on our talent database to contact you about future opportunities; share your details with a client in connection with a specific role; process any special personal information; or place non-essential cookies on your device.

5. Who we share information with

We do not sell personal information. We may share it with:

  • Service providers who support our operations, such as our website host, email, CRM, cloud storage and AI-enabled software providers, under written agreements that require them to keep your information confidential and secure

  • Clients, in connection with a specific role, and only with your prior consent

  • Professional advisors, regulators or authorities, where required by law

6. Cross-border transfers

Some of our service providers, such as cloud hosting or software tools, may store or process information outside South Africa. Where this happens, we will only transfer your information if the recipient is subject to a law, binding corporate rules or a binding agreement that provides a level of protection substantially similar to POPIA, or if another ground permitted by section 72 of POPIA applies, such as your consent.

7. How long we keep it

We keep personal information only for as long as necessary for the purpose it was collected, or as required by law, tax or recordkeeping obligations. If you register your interest in roles, we keep your details on our talent database for 24 months from our last contact with you, with your consent, so that we can let you know about suitable opportunities. You can ask us to remove your details at any time.

8. How we protect it

We take reasonable technical and organisational measures to protect personal information against loss, unauthorised access, alteration or disclosure, appropriate to the sensitivity of the information involved. No system can be guaranteed completely secure, and we will notify you and the Information Regulator if we become aware of a security compromise affecting your personal information, as required by POPIA.

9. Cookies and website analytics

We use cookies and similar technologies to understand how visitors use our website and to improve it. This may include analytics tools that collect anonymised or pseudonymised usage data. Essential cookies needed for the website to work are always on. When you first visit our website, we will ask you to accept or reject non-essential cookies, such as analytics cookies, and you can change your choice at any time. You can also manage or disable cookies through your browser settings; doing so may affect how parts of the website function.

10. Your rights

Under POPIA, you have the right to:

  • Ask us to confirm what personal information we hold about you, and access it

  • Ask us to correct or update inaccurate or outdated information

  • Ask us to delete or destroy personal information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or obtained unlawfully, or that we are no longer authorised to keep

  • Object to our processing of your personal information in certain circumstances, and object at any time to its use for direct marketing (every marketing email we send includes an unsubscribe link)

  • Not be subject to a decision based solely on automated processing that has legal or similarly significant consequences for you

  • Withdraw consent at any time, where our processing is based on your consent, without affecting anything already done before you withdrew it

  • Lodge a complaint with the Information Regulator (see section 13)

To exercise any of these rights, contact us using the details in section 13. Requests for access to records are handled in line with the Promotion of Access to Information Act (PAIA).

11. Children's information

Our website and services are directed at businesses and professionals, not children. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can remove it.

12. Changes to this policy

We may update this policy from time to time to reflect changes in our practices or the law. We will post the updated policy on this page with its effective date. If a change materially affects how we use information you have consented to share, we will let you know and, where required, ask for your consent again.
